Child Visa (Subclass 101)
This visa allows the eligible parent to sponsor their child to live in Australia permanently.
Eligibility
The child must satisfy the following requirements:
- Sponsored by their parents or parent’s partner
- Single
- Younger than 18 years of age
- Between 18 and 25 years of age and I a full-time student or
- 18 years or older, dependent on the parent and cannot work due to disability
- Meet the health requirements
- Meet the character requirements
Sponsor
The parent or the parent’s partner who sponsors the child must be an Australian citizen, a permanent resident or an eligible New Zealand citizen.
Location
The child must be outside or in Australia at the time of application and at the time of decision.
Adoption Visa (Subclass 102)
This is a permanent visa. The adoptive parent sponsors and applies on behalf of the child.
Eligibility
The child must satisfy the following requirements:
- Younger than 18 years of age
- Lives overseas
- Adopted by or is in the process of adoption by the sponsor
- Health and character requirements
- Under 18 years of age before the application is decided
This visa allows the child to:
- travel to and stay in Australia indefinitely
- study, work, and live in Australia
- enroll in Medicare
- apply for Australian citizenship, if eligible
- sponsor eligible relatives to stay permanently in Australia
- travel to and from Australia for five years from visa approval
Sponsor
- Must be the child’s adoptive parent
- Must be older than 18 years of age
- Must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
- Must satisfy the character requirements
- Responsible for the cost of the adoption, provide accommodation, financial support, meet the child’s basic needs in the first two years in Australia, help the child settle in, and help support the child to attend English language classes
Location
The child must be outside Australia at the time of application and at the time of decision.
Orphan Relative Visa (Subclasses 117 and 837)
This is a permanent visa. You can apply for this visa in behalf of the child if the child’s parents are both dead, permanently incapacitated or their whereabouts are unknown, and you want to take care and sponsor the child to stay permanently in Australia with you. Eligibility
The child must satisfy the following requirements:
- Be younger than 18 years of age
- Sponsored by a close relative who is an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen
- Not married or in a de-facto relationship
- Must meet health and character requirements
- Parents are unable to care for the child
- The child’s parents are:
- deceased
- not capable of caring for the child
- cannot be found.
Sponsor
- The brother, sister, grandparent, aunt, uncle, or step-equivalent of the child and must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, have turned 18 years of age and a resident of Australia for a reasonable period
- Must provide a discretionary assurance of support
- Must provide for the child’s accommodation and financial support especially during the first two years in Australia.
- Must help the child settle in Australia and encourage the child to attend English language classes
- Must satisfy character requirements
Location
The child can either be in or outside Australia at the time of application.
Dependent Child (Subclass 445)
An applicant for this visa must be the dependent child of a parent holding a partner visa or a Dependent Child Visa.
This visa is required if children are to be added to the permanent partner visa application of their parent who was granted a temporary partner visa and has applied for a permanent partner visa which has not been decided.
Eligibility
The child must satisfy the following requirements:
- Biological child, step child or the adopted child of their visa-holding parent
- Under 18 years of age or a dependent on their parent’s visa and must be single
- Sponsored by the same person sponsoring their parent
- If older than 18, evidence must be shown of the child’s financial dependency on the parent holding the temporary partner visa or if the child is incapacitated for work
- Meet health and character requirements
Sponsor
- Must already be sponsoring the child’s parent for a permanent partner visa
- Must be prepared to support the child and all all the members of the family included in the application.
Location
The child can either be in or outside Australia at the time of application.
